In this vlog, Mr. Andrew Leroy Rudder discusses a recent 2021 decision of the Ontario Court of Appeal’s outline of the test for admissibility of an expert’s report into evidence and the remedies available to the Court, in situations where the expert’s testimony exceeds the four corners of the report. Some of the remedies Mr. Rudder discusses are denying the expert the opportunity to present the evidence, permitting additional re-examination, providing a correcting instruction to the jury, discharging the jury, and proceeding with a mistrial.
